Data Protection Act 1998 / Data Protection (Bailiwick of Guernsey) Law 2001.

I/we confirm that I/we have the consent of any third party whose details I/we may disclose to Loanspage.co.uk ("You") to disclose such details and to authorise You and the third parties referred to in the paragraph below to process such details for the purposes of assessing my/our application and administering and enforcing any subsequent loan which may be granted to me/us.

I/we agree that You and any lender resulting from this application (the"Lender") shall be entitled to use and process, by any medium, the information given by me/us in this application form and any other information about me/us which may be acquired during the lifetime of any loan ("the Data") for the following purposes:-

i. to provide the Data to and search the files of one or more credit reference or fraud prevention agencies whether before, or during the lifetime of any loan granted to me/us by the Lender, who will keep a record of such search, to confirm the Data, and for the purposes of credit assessment or account administration. I/we understand that You and /or the Lender will record false or inaccurate information if this is given by me/us and fraud is suspected.

ii. To disclose the Data to credit reference agencies when requested by them for consideration of any future applications for finance made by me or members of my household/family, or for fraud prevention and/or tracing debtors (the agencies may also disclose the Data to other lenders for these purposes).

iii. to disclose the Data to any other company within the Lender's group of companies and/or to any third parties (for example, debt counsellors and insurers) at any time for the purposes of assessing my/our application and administering and enforcing any subsequent loan whether during the course of my/our application or during the lifetime of any loan granted pursuant to such application.

iv. to disclose the Data to any third party who replaces or who may replace my/our Lender.

Credit Reference Agencies.

The main credit reference agencies are:

All the FISA lending companies use one or more of these agencies. Credit reference agencies keep a wide range of information. This includes information from the electoral roll (sometimes known as the voters roll) and records of most county court judgements and bankruptcies. They also retain information relating to previous and existing credit and a record of searches made against the file. The lenders share information through the agencies providing a history of how punctually payments are being made or have been made. Loan information is usually held on file for 6 years. Details of the voter's roll may be held for much longer. Information about credit searches is kept for up to two years.

Other Agencies.

CIFAS

Reports from CIFAS relating to fraud and fraud avoidance are also available to its members (most lenders) - these contain information indicating that fraud, or attempted fraud, has been notified by a lender. The information might not directly relate to you, it might relate to someone who has tried to impersonate you. Data available to members of CIFAS, may also be used to help make decisions on motor, household, credit, life and other insurance proposals for you and members of your household.

CML Repossession Register

The Council of Mortgage Lenders, Repossession Register is available to its members through the main credit reference agencies. If you have had a property repossessed or have given it up voluntarily this will show on the register.

GAIN

A file may also show a "gone away" marker indicating that a member of the "Gone Away Information Network" has reported that they cannot trace a customer who is in arrears with payments. Alternatively, the marker may indicate a new address, which the "gone away" has been traced to.

HUNTER

Files in this register contain detailed information on applications made and loans given. It is aimed at tracing fraudsters who use different combinations of information to obtain credit dishonestly. It checks and counter checks information given on application forms.
If your broker or lender uses any of the above agencies they will be able to confirm their contact addresses. CIFAS information is intended to warn lenders and act as a protection for innocent customers.


Personal details and data privacy.

The personal details which you submit to us (Personal Data) are held by Loanspage.co.uk for its own use.  We may use the information to contact you by telephone, email or by post with regard to the processing of your application. This permission also extends to any company we have passed your application onto who we believe may be able to assist you in you loan application. We may also offer you other financial products which may be available from our product providers from time to time that we feel may be of interest to you by telephone, post, fax, mobile telephone text or email.

It is your responsibility to ensure that your Personal Data is accurate and up to date and to inform us of any changes that need to be made. Loanspage.co.uk may use the Personal Data for the purposes they have notified to the Office of Information. By submitting your Personal Data you consent to it being processed by Loanspage.co.uk.

Information held by us will be processed only for purposes for which we have registered under the Data Protection Act 1998. Upon you making a request in writing we will provide you with a copy of the information which we hold concerning you upon payment of a fee.

If you decide to respond direct to any third party provider or broker ("Third Party") to whom we have passed your details, from that point on the information about you which is held by that Third Party, including the information we have passed to them and any further information requested by, and supplied by you to, the Third Party will be held by that Third Party for the purposes set out in their own Data Protection Statement. These uses may go beyond those disclosed by Loanspage.co.uk and you are strongly advised to read that Third Party's Data Protection Statement and satisfy yourself as to the purposes for which the Third Party will use your personal information. Loanspage.co.uk has no responsibility for any uses to which a Third Party provider puts your personal information beyond those disclosed in this Data Protection Statement, once you have entered into direct communication with that Third Party.
